Bakers Guide: Using Before The Event (‘BTE’) Legal Expenses Insurance for your injury claim

If you’ve had any sort of personal injury claim, such as an accident whilst driving, on a motorbike or perhaps an injury suffered whilst you were at work or in a shop or restaurant, you may discover that you have already paid for legal expenses insurance – known as Before The Event or BTE Insurance – as an add-on to an existing insurance policy (such as car, bike, home or credit card insurance). If this is the case, then its worthwhile understanding how BTE Insurance works and what it does / doesn’t cover as outlined in the top 4 frequently asked questions listed below:

Q: My BTE legal expenses insurance will cover all of my legal costs involved in making a claim?
A: Most BTE legal expenses policies will cover a certain amount of costs, but only up to what is known as the Limit Of Indemnity, which is the maximum amount the policy will cover. Whilst this may be sufficient for your claim, more complex cases could well need additional cover which can be obtained once a solicitor has properly reviewed your claim.

Q: I’ve been told that if I want to use my BTE legal expenses insurance, then I will have to use the solicitor that the insurer wants me to use?
A: This is a common misconception – despite what your insurer might say, it is absolutely YOUR right to decide which solicitor you want to handle your claim. Make sure that your solicitor deals with your BTE insurer on this important point, something we are happy to do here at Bakers.

Q: My BTE legal expenses insurance will cover any type of personal injury claim?
A: Whilst your BTE policy may be adequate for more straightforward and one-off accident compensation claims, they rarely cover more complex cases such as industrial disease (such as mesothelioma, asbestosis, noise induced hearing loss, etc) or other claims where problems and injuries become more apparent over time (such as RSI or chronic back pain claims).

Q: If I use my BTE policy I won’t have to pay anything to the insurer as part of my claim?
A: Check carefully! Whilst this is often the case, there may be clauses hidden away in the small print such as additional excess charges.
